In a marathon session lasting over 12 hours, the panel of judges, headed by Haruna Tsammani, delivered a unanimous verdict on Wednesday, dismissing all three petitions challenging Mr. Tinubu’s election.

All five members of the Presidential Election Petition Court in Abuja unequivocally affirmed Bola Tinubu as the duly elected President of Nigeria. This decisive judicial resolution puts to rest the lingering questions about the legitimacy of his election that had persisted for more than six months.
During the extensive judgment, Haruna Tsammani, in his lead judgment, upheld Mr. Tinubu’s election and dismissed all three petitions challenging it. The remaining members of the panel, namely Stephen Adah, Misitura Bolaji-Yusuf (the sole female member), Moses Ugo, and Abbah Mohammed, subsequently concurred with the rationale and conclusion presented in the lead judgment.
The petitions brought before the court were filed within three weeks of Mr. Tinubu’s declaration as the winner of the February 25 presidential election on March 1. The petitioners included Atiku Abubakar of the Peoples Democratic Party (PDP), who came second in the election, Peter Obi of the Labour Party, the third-place candidate, and the All Peoples Movement (APM), whose presidential candidate received just over 2,000 votes out of the 24 million cast.
The panel unanimously emphasized the complete absence of credible evidence provided by the petitioners to substantiate their claims. Some of the legal arguments put forth by Atiku and Mr. Obi were described as “fallacious and absurd” by the court.
“Based on the aforementioned reasons, it is abundantly clear that the petitioners have failed to demonstrate that the 2023 presidential election and the victory of the second respondent (Mr. Tinubu) were tainted by corrupt practices or violations of the Electoral Act 2022,” stated Mr. Tsammani.
This declaration was made when the courtroom audience had significantly dwindled due to the protracted proceedings. Vice-President Kashim Shettima, whose nomination process was a central point of contention, was present throughout the session. However, President Tinubu, Atiku, and Mr. Obi, who had been regular attendees during the hearing stage, were absent.
